If transactions involves an export of items from the United States (including, but not limited to, commodities, software or technology) subject to the Export Administration Regulations, such items were exported from the United States by Seller in accordance with the Export Administration Regulations. Customer agrees that it will not divert, use, export or re-export such items contrary to United States law. Any diversion of an item contrary to US law is strictly prohibited. Customer expressly acknowledges and agrees that it will not export, re-export, or provide such item(s) to any entity or person within any country that is subject to United States economic sanctions within the control of the Office of Foreign Assets Control without obtaining prior authorization from the United States Government. All products may be returned within 90 days of receipt of the item. Items that are returned within 90 days of receipt in unused condition shall be subject to a full refund. If the item is returned in used condition, there will be a 25% restocking fee deducted from the refund. All Final Sale merchandise cannot be returned. Other nonreturnable purchases include digital content, gift packaging, memberships, completed services, consumable items including 3D printer filament, and items returned that are damaged, unsanitary or missing major contents.
Kreatos/DIYcore Warranty
New machines sold by 3DFused carry a one-year warranty effective from the date of delivery. All 3DFused mechanical components are warranted against manufacturer’s defects in material and workmanship for a period of one year from the time of delivery. All 3DFused electrical components are similarly warranted for a period of one year from the time of delivery.
All DIYcore Motion Kits, Custom Machined Printers & Kreatos Printers will be subject to a 30% restocking fee if order is cancelled prior to shipping.3DFused sole obligation under this warranty is limited to repairing or replacing the defective part, at 3DFused option, provided the item is properly returned to 3DFused for repair as discussed below. Modifications to machine parts and components will void the warranty agreement. Tampering or removal of 3DFused product labels and markings will also void the warranty agreement. We require that the defective item/part be returned to 3DFused with the description of the issue. Any components returned to 3DFused must be returned using adequate packaging to ensure the item is not damaged in transit. The provisions of this warranty shall not apply to any product which has been subjected to tampering, abuse, improper set up or operating conditions, misuse, or lack of proper maintenance or unauthorized user adjustment. 3DFused makes no warranty, implied or expressed that its products are fit for any use or purpose to which they may be put by the customer, whether such use or purpose has been disclosed to 3DFused in specifications or drawings previously or subsequently provided, and whether or not 3DFused’s products are specifically designed and/or manufactured for such a purpose. This limited warranty does not apply to natural disasters, acts of terrorism, normal wear and tear, product failure due to lack of maintenance or cleaning, damage caused by accident, neglect, lack of or inadequate dust collection, misuse, abuse or damage caused where repair or alterations have been made or attempted by others.
LIMITATION OF REMEDY
In no event shall 3DFused be liable for any incidental, consequential or special damages of any kind or nature whatsoever. 3DFused is in no way liable for any lost profits arising from or connected to this agreement or items sold under this agreement, whether alleged to arise from breach of contract, expressed or implied, or in tort, including, without limitation, negligence, failure to warn, or strict liability.
FIELD SERVICE
Repairs are ordinarily done at 3DFused’s facility where all necessary instrumentation is available. This instrumentation is difficult to transport such that field service is severely limited and will only be supplied at 3DFused’s discretion. If field service is required and is performed at 3DFused’s sole discretion, all relevant expenses, including transportation, travel time, subsistence costs, and the prevailing labor cost per hour ($75.00 minimum) are the sole responsibility of the customer.
UNFORESEEN CIRCUMSTANCES
3DFused is not liable for delay or failure to perform any obligations hereunder by reason of circumstances beyond its reasonable control. These circumstances include, but are not limited to, accidents, acts of nature, strikes, labor disputes, laws, rules, or regulations of any government or government agency, fires, floods, delays or failures of carriers or suppliers, shortages of materials, and any other event beyond 3DFused’s control.
ENTIRE AGREEMENT/GOVERNING LAW
The terms and conditions contained herein shall constitute the entire agreement concerning the terms and conditions for the limited warranty described hereunder. No oral or other representations are in effect. This agreement shall be governed in all respects by the laws of the United States of America. No legal action may be taken by any party more than one year after the date of purchase.
